  INFORMATIONS GENERALES.   L’Académie des Privatistes Européens a été fondé par acte notarié le 9 novembre 1992 à Pavie. Ses membres fondateurs furent: Prof. Alberto Trabucchi (Université de Padoue), Prof. Franz Wieacker (Université de Gothingen), Prof. André Tunc (Université de Paris ‘Sorbonne-Panthéon’), Prof. José Luis de los Mozos (Université de Valladolid), S.E. Prof. Antonio Brancaccio (Premier Président de la Cour de Cassation italienne), Prof. Peter Stein (Université de Cambridge), Prof. Giuseppe Gandolfi (Université de Pavie).
            Comme le précise l’art. 1 de ses Statuts, l’Académie “se propose d’apporter sa contribution, par la recherche scientifique, à l’unification et à la future interprétation et application du droit privé en Europe, dans l’esprit des conventions communautaires”, et en outre “ de promouvoir le développement de la culture juridique européiste ”.
  Le siège officiel de l’Académie se trouve à Pavie, dans l’édifice central de l’Université: Strada Nuova 65, I - 27100 Pavia (Italia), tél. 0039-038233955; fax 0039-0382504435. C’est là que se déroulent haituellement les colloques académiques.

L'élaboration du ‘projet’ a concrètement débuté en 1995. La rédaction en langue française du Livre premier portant sur ‘les contrats en général’ (art. 1-173 subdivisés dans les onze titres suivants: dispositions préalables, formation du contrat, contenu du contrat, forme du contrat, interprétation du contrat, effets du contrat, exécution du contrat, inexécution du contrat, cession de contrat et des rapports qui naissent du contrat, extinction du contrat et des rapports qui naissent du contrat, autres anomalies du contrat et remèdes) a pris fin en 1999. Le projet du Livre premier a été publié, accompagné des rapports du coordinateur, en 2001. Une deuxième édition du projet, revue et corrigée, accompagnée des rapports du coordinateur, dotée d’un exhaustif index analytique-alphabétique et suivie des traductions intégrales du projet en allemand, anglais, espagnol et italien a été publiée en 2002. Une édition ‘de poche’, ultérieurement revue et corrigée, a été publiée en 2004.             L’Académie se consacre actuellement à la rédaction du Livre deuxième du projet, concernant ‘les contrats en particulier’. 


          ALLGEMEINE INFORMATIONEN.   Die Akademie europäischer Privatrechtswissenschaftler wurde durch öffentliche Urkunde am 9. November 1992 in Pavia gegründet. Dies waren die Gründungsmitglieder: Prof. Alberto Trabucchi (Universität Padua), Prof. Franz Wieacker (Universität Göttingen), Prof. André Tunc (Universität Paris ‘Sorbonne-Panthéon’), Prof. José Luis de los Mozos (Universität Valladolid), S.E. Prof. Antonio Brancaccio (Erster Präsident des italienischen Kassationsgerichtshofs), Prof. Peter Stein (Universität Cambridge), Prof. Giuseppe Gandolfi (Universität Pavia).

            Wie in Artikel 1 ihrer Satzung geregelt setzt sich die Akademie zum Ziel “durch wissenschaftliche Forschung auf dem Boden der Gemeinschaftsverträge einen Beitrag zur Vereinheitlichung, Auslegung und Anwendung des europäischen Privatrechts zu leisten”, und weiterhin “die europäische Rechtskultur zu fördern”.

            Das Ziel, den Entwurf eines “europäischen Vertragsgesetzbuchs” zu verfassen, und der Wunsch, dass diese Akademie gegründet würde, wurden bei dem Studientreffen formuliert, das am 20. und 21. Oktober 1990 in Pavia stattfand und an dem Juristen aus den Staaten der Europäischen Gemeinschaft sowie aus Österreich und der Schweiz teilnahmen. Bis 1994 widmete die Akademie sich der Untersuchung verschiedener Problemstellungen (Methode, Inhalt, Stil, etc.), die für die spätere Abfassung des Entwurfs eines „europäischen Vertragsgesetzbuchs“ im Voraus geklärt werden mussten.             Die Abfassung des ‘Entwurfs’ beginnt konkret im Jahr 1995. 1999 wurde das erste Buch in französischer Sprache über ‘die Verträge im allgemeinen’ (Art. 1-173, unterteilt in folgende elf Titel: Einleitende Bestimmungen, Entstehung des Vertrages, Inhalt des Vertrages, Form des Vertrages, Vertragsauslegung, Vertragswirkungen, Erfüllung des Vertrages, Nichterfüllung des Vertrages, Vertragsübernahme und Übernahme vertraglich begründeter Rechtsverhältnisse, Erlöschen des Vertrages und vertraglich begründeter Rechtsverhältnisse, Andere Vertragsunregelmäßigkeiten und Rechtsmittel) abgefasst. Der Entwurf des ersten Buches wurde zusammen mit den Berichten des Koordinators 2001 veröffentlicht. Eine zweite, überarbeitete und berichtigte Ausgabe des Entwurfs mit den Berichten des Koordinators sowie einem erschöpfenden Stichwortverzeichnis und den vollständigen Übersetzungen des Entwurfs ins Deutsche, Englische, Spanische und Italienische wurde im Jahr 2002 veröffentlicht. Eine nochmals überarbeitete und korrigierte Taschenbuchausgabe ist 2004 erschienen.             Zur Zeit widmet sich die Akademie der Abfassung des zweiten Buchs des Entwurfs über ‘die einzelnen Verträge’.

            GENERAL INFORMATION. The Academy of European Private Lawyers was formed by public act in Pavia on 9^th  November 1992. The following were the founder partners: Prof. Alberto Trabucchi (University of Padua), Prof. Franz Wieacker (Università di Gőttingen), Prof. André Tunc (University of Paris ‘Sorbonne-Panthéon’), Prof. José Luis de los Mozos (University of Valladolid), Exc.             As stated in Art. 1 of the Statute of the Academy, “its aim is to contribute, through scientific research, to the unification and the future interpretation and enforcement of private law in Europe, in the spirit of the community conventions”, and also “to promote the development of a legal culture leading to European unification”.

            The intention of drawing up the draft of a “European Contract Code”, and the hope that this Academy would be founded, were expressed at the study meeting that was conducted at Pavia on 20th-21st October 1990, in which jurists belonging to the States of the European Community, and also Austria and Switzerland, participated. And until 1994 the Academy dedicated itself to the examination of various problems (of method, of content, of style, etc.) which were to be dealt with in a preliminary phase, in view of the later drawing up of the draft of a “European Contract Code”.             The drawing up of the ‘draft’ began effectively in 1995. In 1999 the draft in the French language of Book One on ‘contracts in general’ was concluded (artt. 1-173 subdivided into the following eleven chapters: preliminary provisions, formation of contract, content of contract, form of contract, interpretation of contract, effects of contract, performance of contract, non-performance of contract, assignment of contract and of relationships arising therefrom,  extinction of contract and derived relationships, other contractual anomalies and remedies. The draft of Book One was published, with the reports of the coordinator, in 2001. A second edition, revised and corrected, of this draft, with the reports of the coordinator, and in addition an exhaustive alphabetical index and the complete translations of the draft into German, English, Spanish and Italian was published in 2002. A further ‘pocket’ edition, newly revised and corrected, was published in 2004.            El propósito de redactar el Proyecto de un "Código Europeo de Contratos", y el deseo de que se fundara esta Academia, se formularon en el Encuentro de Estudios que se desarrolló en Pavía durante los días 20-21 del mes de octubre de 1990, en el que intervinieron juristas pertenecientes a

La redacción del Proyecto comenzó en 1995. En 1999 se culminó la redacción en francés del Libro I sobre los contratos en general  (arts. 1-173, subdivididos en los once Títulos siguientes: Disposiciones preliminares, Formación del contrato, Contenido del contrato, Interpretación
del contrato, Efectos del contrato, Cumplimiento del contrato,Incumplimiento del contrato, Cesión del contrato y de las relaciones que nacen del mismo, Extinción del contrato y de las relaciones
que nacen del mismo, Otras anomalías del contrato y sus remedios) El Proyecto del Libro I  ha sido publicado juntamente con las Relaciones del Coordinador, en 2002. Una segunda edición,revisada y corregida del mismo, con las Relaciones del Coordinador, conjuntamente con un amplio índice
analítico-alfabético, y las traducciones integrales del Proyecto en alemán, inglés, español e italiano, ha sido publicada en 2002.Una reedición "de bolsillo", ulteriormente revisada y corregida, se ha publicado en 2004.             Il proposito di redigere il progetto di un “Codice europeo dei contratti”, e l’auspicio che venisse fondata questa Accademia, erano stati formulati nell’incontro di studio che si svolse a Pavia il 20-21 ottobre 1990, e al quale intervennero giuristi appartenenti agli Stati della Comunità Europea oltre che all’Austria e alla Svizzera. E sino al 1994 l’Accademia si dedicò all’esame di vari problemi (di metodo, di contenuto, di stile, ecc.) che dovevano essere affrontati in via preliminare, in funzione della successiva stesura del progetto di un “Codice europeo dei contratti”.             La redazione del ‘progetto’ ha avuto concretamente inizio nel 1995. Il progetto del Libro primo è stato pubblicato, con le relazioni del coordinatore, nel 2001. Una seconda edizione, riveduta e corretta, del progetto stesso, con le relazioni del coordinatore, nonché un ampio indice analitico-alfabetico e le traduzioni integrali del progetto medesimo in tedesco, inglese, spagnolo e italiano è stata pubblicata nel 2002. Una riedizione ‘tascabile’, ulteriormente riveduta e corretta, è stata pubblicata nel 2004.
